Question by : If both domestic partners are retired do we still have to send in form 555 with our separate federal tax forms?
One partner does not normally have to send in a return because retirement income is so low. Our community property is under $ 2000. We live in a community property state.
Form 555 should have read worksheet 555. If we file separately there is no box on the 1040 for domestic partners.
Best answer:
Answer by taxreff
If I am understanding the circumstances correctly, you can only file as single (or HOH assuming the requirements are met) for federal tax purposes. Consequently, you would file your 1040 based on your circumstances alone.
Your state return may allow a different filing status.
