Question by : How to get my green card through marriage if I’m living outside of USA?
Hi, my name is Carla, I’m brazilian and my bf is from New Jersey. We met almost 2 years ago when I was living in USA as an exchange student. I came back to Brazil 6 months ago to get my Bachelor´s degree in Petroleum Engineering. I already have an Associates degree in Petroleum Technology but I couldn’t get a job in my field in the USA because I didn’t have any previous experience and I didnt have autorization to work either.
Now, in Brazil, I’m working in my field and I’m also back to school to get my Bachelor´s. My bf and I want to get married now in July (I’ll be going to New Jersey for vacation and to meet him and his family) and I’m just wondering if I can get my green card even if I’m living in Brazil. Can I get a green card if Im living in Brazil? Will it take longer than usual or it will be faster if Im living down here? The plan is I get an autorization to work while Im still here in my home country then apply for a job in the USA. After I get a job, I would transfer my college.. since I would have (by december 2011) just 3 more semesters left to finish school I would have to study justo more 1 year and 6 months in USA (I’m not sure about that since to get a Engineering degree in the USA takes 4 years but in Brazil it takes 5 years)…
While I couldn’t get my petroleum engineering degree in the USA, I would work as a Petroleum Technologist. Is that possible? Can I do that?
If someone could help me, I’d really appreciate it.

You can’t get your greencard, but you can do this a different way. Your bf can apply for a “Fiance” visa. This will give you a visa to enter the country to get married (You have 2 months to get married after entering the country). After marriage, you can apply for your green card, and will get “temporary” residency. This will last for 2 years, and be converted to permanent residency.
